THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1323 OF 2017 O R D E R :

The petitioner herein filed Writ Petition No. 12412 of 2017 questioning rejection of his Application seeking permission to construct a building, dated 05.10.2016, vide order dated 23.11.2016. Considering the fair submission made by the learned Standing Counsel for the Corporation, on instructions, that the rejection was made by oversight, recording the said submission, the Writ Petition was allowed, setting aside the order dated 23.11.2016, with a direction to the respondent-Corporation to reconsider the Application of the petitioner and process the same in accordance with law, within a period of four weeks from the date of receipt of a copy of that order. Alleging violation of the said order, this Contempt Case is filed.

Today, learned Standing Counsel for the Corporation submits that the Application of the petitioner was processed on 27.08.2018 and the respondent Corporation had pointed out certain shortfalls, vide intimation letters, to be fulfilled by the petitioner. It is yet another letter given on 05.09.2018 intimating the petitioner with respect to the shortfalls, which were directed to be fulfilled within seven days.

Inasmuch as the Application of the petitioner is under process, it is for the petitioner to approach the authorities and fulfil the shortfalls, on which, the same shall be considered and orders necessary be passed.

The Contempt Case is therefore, closed.
