CONTEMPT CASE No.29 of 2016 ORDER :

This contempt case is filed to punish the respondents for their willful and deliberate disobedience of the order passed by this Court on 22.09.2015 in W.P.No.30804 of 2015.

2. By way of interim order this Court directed the respondentMunicipal Corporation (2nd respondent) that no construction takes place in the subject plot, if no building permission is granted.

3. Consequent to the interim order, the petitioner seems to have submitted a representation. On the representation of the petitioner, site inspection was conducted by Town Planning Building Overseer and according to the report of the Town Planning Building Overseer, no construction is made in the subject property as alleged by the petitioner.

4. No material is brought to the notice of this Court which would show that respondents 4 and 5 in the writ petition were undertaking construction without obtaining permission and even though Municipal Corporation was appraised, the Corporation did not take any action. There is no merit in the allegation that the respondents committed contempt of the order passed by this Court.

Accordingly, the Contempt Case is closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
