HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 20530 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the action of the respondents 1 to 3 in toeing the fourth respondent and allowing him to dispossess the petitioner-company from its Tobacco Purchase Division Property at Grand Trunk Road, Guntur, for recovery of money, as illegal, arbitrary and in violation of Article 14, 21 and 300-A of the Constitution of India and consequently to declare the action of the fourth respondent as illegal, void and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [AP] appearing for the respondents 1 to 3.

3. This writ petition is filed under the apprehension that the third respondent at the behest of the fourth respondent is supporting and keeping silent upon the action of the fourth respondent in dispossessing the petitioner from the subject property.

4. Mr.Ramesh Babu, Assistant Government Pleader [AP] submits that no such unlawful interference is made or supporting is made by the third respondent in favour of the fourth respondent.

5. In view of the submission made by the Assistant Government Pleader, this Court is of the view that the petitioner is

at liberty to avail the alternative remedy available under law before civil court for any such dispossession seeking injunction, since the police is not committing any unlawful activity for violation of law.

6. In view of the same, this writ petition is dismissed, giving liberty to the petitioner to avail the efficacious alternative remedy under law, if so advised. No costs.

7. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
