M/S Sudharma Finance v. The State Of Telangana
THE HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON NO.7652 OF 2019
O R D E R
The grievance of the petitioners is that the revenue authorities are not disposing of their representations dated 25.03.2019 and 26.03.2019 in relation to release of their vehicles, details of which are set out in the writ prayer.
It is the case of the petitioners that in the process of their vehicle financing business, the subject vehicles were seized by them owing to non-payment of monthly dues and while so, the land in which they parked the said vehicles was subjected to proceedings under Section 145 CrPC. On this basis, the vehicles in question are not being released. The petitioners' representations in this regard are pending consideration before the revenue authorities.
This being the situation, this Court sees no purpose served in entertaining this writ petition for adjudication. It is for the authorities concerned to consider the representations made by the petitioners in the light of the aforestated facts.
The writ petition is accordingly disposed of directing the Revenue Divisional Officer-cum-Special Divisional Magistrate, Malkajgiri Division, Medchal-Malkajgiri District, and the Tahsildar, Malkajgiri Mandal, MedchalMalkajgiri District, to take appropriate action upon the petitioners' representations dated 25.03.2019 and 26.03.2019 expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 21st JUNE, 2019 PGS
