THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18091 of 2017 ORDER:
This Writ Petition is filed challenging the proceedings dated 22.05.2017 issued by the second respondent suspending the licence to the petitioner's shop pending enquiry in the interest of public health.
The reason shown for such an order was that the Prohibition & Excise Inspector, Chittoor Urban, submitted a report stating that on 16.05.2017 at about 11:45 am when he along with other Task Force Personnel inspected the shop, he found one person conducting sales in the shop without producing any licence for sale of toddy, but he was selling toddy in the shop. The toddy was drawn into three bottles from plastic drum as samples for the purpose of chemical analysis duly sealed and labeled. The accused was arrested after informing the grounds of arrest, the drum containing toddy was seized, and three sample bottles under the cover of panchanama were drafted on the spot.
In view of the aforesaid allegation, the order of suspension pending enquiry cannot be found fault. However, respondent Nos.2 and 3 are directed to complete the enquiry, as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 14.06.2017 vs
