HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42622 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to call for the records relating to FIR No.184 of 2016 on the file of Keesara Police Station, Cyberabad, for the offences punishable under Sections 120(B), 182, 418, 419, 420, 467, 468 and 471 IPC and 3 (1) (q), 3 (2)(v), (va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (for short 'the Act'), and quash the same. Heard and perused the material available on record. The petitioner is the Principal of Hasvitha Institute of Engineering and Technology. The allegation against the petitioner is that she conspired with the Chairman of the college and created forged documents of the 3rd respondent and cheated the government by claiming reimbursement fee and scholarship of the 3rd respondent though they did not allow the 3rd respondent to complete her M.Tech. Course in the said college.

The grievance of the petitioner is that she is no way concerned with the allegations levelled against her and there are no specific allegation against her and that the fee reimbursement and other aspects are looked after by the management and she is not at all concerned with the same and that the main allegations are against A1 only and A1 was already arrested and released on bail.

The petitioner filed this writ petition challenging the investigation in the above crime. Even though this Court is not inclined to interfere with the investigation in the above crime, taking into consideration the

facts and circumstances of the case, without going into the merits of the case, this Court is of the view that the above crime can be investigated into, without arresting the petitioner.

Accordingly, the 2nd respondent is directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioner. The petitioner is also directed to appear before the investigating officer concerned, as and when required, and cooperate with the investigation. In case, the charge sheet is filed before the Court concerned, and summons are received by the petitioner, she shall appear before the Court concerned and execute a bond for a sum of Rs.5,000/ - (Rupees five thousand only) with one surety for the like sum, for his future appearance. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
