THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.1910 of 2022 ORDER:

This Criminal Petition under Sections 437 and 439 Criminal Procedure Code are filed by petitioners 1 and 2, who are arrayed as accused Nos.1 and 2 in Crime No.37 of 2022 of Prohibition and Excise Station, Bhadrachalam, registered for the offences punishable under Section 8 (c ) r/w.20 (b) (ii)(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, seeking bail. 2.

Briefly stated, the case of the prosecution is that, the Excise and Enforcement Team conducted raid and allegedly detected 8 Kgs of Ganja in the possession of the petitioners herein. Accordingly, petitioners are arrested and remanded to judicial custody on 08.02.2022.

Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the State-respondent and perused the record.

The learned Counsel for the petitioners submits that the seizure is 8 Kgs, which is less than commercial quantity and there are no other cases pending against the petitioners herein.

Learned Additional Public Prosecutor, though does not dispute that there are no other cases, prays for imposing condition of local sureties.

Accordingly, the Criminal Petition is allowed, directing the petitioners to be released on bail on their executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each, with two sureties for alike sum each i.e, among which one is local surety, to the satisfaction of Judicial Magistrate of First Class, Bhadrachalam. The petitioners shall appear before the concerned Police Station on every 2nd and 4th Sunday between 10.00 a.m and 12 Noon for a period of three months or till filing of charge sheet, whichever is earlier. Further the petitioners shall make themselves available for investigation as and when required.
