ORDER

Heard learned counsel appearing for the petitioners and learned Government Pleader appearing for respondents 1 to 4. None appeared for the 5th respondent in spite of service of notice.

Challenging registration of Cr.No.52 of 2016 by the 4th respondent, the present writ petition is filed. Based on the complaint lodged by the 5th respondent, the 4th respondent registered Cr.No.52 of 2016 on 21.12.2016 for the offences punishable under Sections 143, 324, 509 read with Section 149 IPC and Section 3 (1) (S) (F) (R) clause 2 (va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

A perusal of the complaint discloses some offences under the Indian Penal Code, which require investigation. Except mentioning the caste name of the complainant, no specific allegations were made in the complaint.

A counter-affidavit is filed on behalf of respondents 1 to 4 stating that investigation is completed and charge sheet is filed in the present crime.

In view of the same, no further orders are necessary in the present writ petition. However, it is open to respondents 3 and 4 to file appropriate charge sheet before the Court concerned without arresting the petitioners.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending, shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 7th March, 2017 rkk
