THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7677 of 2019 O R D E R:

In this writ petition, grievance of the petitioners is that they are the owners of plot Nos.6/1 and 6/3 in Survey No.330 situated at Nagarkurnool Village and Mandal, Nagarkurnool District; that though they obtained permission for construction of stilt+ four floors, they constructed cellar + five floors; and that respondent No.2 without issuing any notice, straightaway passed the provisional order, dated 13.12.2018, followed by notice, dated 20.12.2018, directing them to remove the unauthorised constructions.

Heard learned counsel for the petitioners and learned Standing Counsel for respondent No.2.

The petitioners themselves admitted that they constructed cellar + five floors. Therefore, the petitioners by treating the provisional order, dated 13.12.2018, as notice issued under Sections 228(1) and 217 of the Telangana Municipalities Act, 1965, shall offer their explanation within two weeks from today. The respondent authorities shall consider the same and take necessary action within four weeks thereafter, in accordance with law. The writ petition is accordingly disposed of. Miscellaneous applications, if any pending, in the Writ Petition shall also stand disposed of. No costs.
