HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CIVIL MISCELLANEOUS PETITION No.237 OF 2014 ORDER:

Heard Sri Karri Murali Krishna, learned counsel for the petitioner.

He would submit that as directed by this Court notices have been sent earlier, and again sent even to the learned counsel for the respondent before the Court below, and even filed Memos evidencing taking out notices by Registered Post with Acknowledgement Due, and one such Memo dated 30.11.2015 shows that notices were sent to the party as well as the counsel in F.C.O.P. No.206 of 2013 on the file of Judge, Family Court, Nellore, S.P.S.R. Nellore District. Learned counsel would submit that it is difficult for the petitioner-wife to travel to Nellore, as she is resident of Kadapa, and besides financial constraints, even she has got children as well as there has been threat to her life if she attends to the Court at Nellore.

Keeping in view that the reasons assigned by the petitioner is convincing, to avoid hardship to her, the request is acceded to by allowing the Transfer Civil Miscellaneous Petition. Therefore, the Transfer Civil Miscellaneous Petition is allowed. F.C.O.P.No.206 of 2013 on the file of Judge, Family Court, Nellore, S.P.S.R. Nellore District, is withdrawn and transferred to the file of Judge, Family Court, Kadapa, Y.S.R. District. The transferee Court shall issue notices to the parties and then proceed with further proceedings. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions if any pending in the Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 06.04.2018 gbs
