THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1200 OF 2016 ORDER:

The present criminal petition is filed by the petitioner seeking to quash the proceedings in C.C.No.880 of 2014 on the file of the I Additional Judicial Magistrate of First Class, Khammam, arising out of an offence under Section 420 IPC.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner herein has not committed any offence and he has been falsely implicated in the present crime. This Court is of the view that truth or otherwise of the allegations made against the petitioner can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioner. Considering the facts and circumstances of the case, the presence of the petitioner herein before the Court below is dispensed with except on the dates when the trial Court insists for his appearance. The petitioner shall be represented through his counsel before the Court below on all hearing dates. The Court below is directed to dispose of the case as expeditiously as possible, preferably within a period of six months.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 12.04.2016 pln
