HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5189 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioners/A1 and A2 seek to quash the proceedings in C.C.No.422 of 2007 on the file of Special Judicial First Class Magistrate, Excise Court, Eluru, registered for the offence under Sections 447, 506 r/w 34 IPC.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 29.06.2018 of Sub-Inspector of Police, Eluru Rural Police Station, West Godavari District and submitted that after filing of charge sheet, C.C.No.422 of 2007 was registered and the same was ended in acquittal vide judgment dated 28.12.2015 and therefore, the petition which is filed to quash the proceedings in C.C.No.422 of 2007 has become infructuous and hence the same may be dismissed. 3.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
