THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.18107 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in proposing to retire the petitioner on attaining the age of 58 years instead of 60 years, as arbitrary and against the provisions of Act 23 of 1984 which has been made applicable to the Tirumala Tirupati Devasthanams by virtue of G.O.Ms.No.1060 Revenue (ENDTS.III) Department, dated 24.10.1989. Subsequently direct the respondents to continue the petitioner in service till such time he attains the age of 60 years which is the normal age of retirement for workmen of the Tirumala Tirupati Devasthanam Printing Press with all the consequential benefits.

2. The learned counsel for the petitioner submitted that the retiral benefits are not granted to the petitioner.

The learned counsel for both parties with one voice submitted that same question fell for consideration before the Division Bench of this Court vide common order dated 27.07.2010 in W.A.No.230 of 2003 and W.P.Nos.8759, 10440, 18233 and 18229 of 2003, 9519 and 21564 of 2004, 15054 of 2005 and 13241 of 2007. The petitioners therein were allowed to claim the age of superannuation as 60 years. Learned counsel for both parties further submitted that the petitioner continued in service till attaining the age of superannuation i.e., 60 years.

4. In view of the submission made by the learned counsel for both parties, the Writ Petition is disposed of in terms of the common order dated 27.7.2010 in W.A. No.230 of 2003 and batch. The petitioner is entitled to the retiral benefits accordingly. No costs.

5. Consequently, Miscellaneous Petitions, if any, pending in this

Writ Petition shall stand closed.
