HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23798 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second and third respondents in not considering the application of the petitioners dated 30.06.2016 for grant of permission for cultivating L.Vannamel Aqua Culture for agricultural period 201617 in fish tanks situated in Sy.No.237/1A and 238/1A of Kommu Chikkala Village, Poduru Mandal, West Godavari District without considering the G.O.Ms.No.7 and G.O.Ms.No.15 dated 16.03.2013 and 26.05.2015 as illegal and arbitrary and consequently set aside the same.

Heard the learned counsel for the petitioners and the learned Government Pleader for Fisheries.

The only request made by the petitioners is to direct the respondents 2 and 3 to consider their representation dated 30.06.2016.

Having regard to the facts and circumstances of the case and in the light of G.O.Ms.No.7 and G.O.Ms.No.15 dated 16.03.2013 and 26.05.2015 respectively, the second and third respondents are hereby directed to consider the case of the petitioners and pass appropriate orders in accordance with law as early as possible, preferably, within a period of one month from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. As

a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
