THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.8735 OF 2021 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, wherein, the following prayer is made:

"... to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action on the part of the respondents in not appointing the petitioner as Dealer of FP Shop No. B1/421/2004, located at House No. 3-1-1, Gopalswamy Road, Kamareddy on compassionate grounds or in not transferring the said dealership in the name of the petitioner as illegal, arbitrary, violative of principles of natural justice, and also violative of Articles 14 and 21 of the Constitution of India and to pass such other order or orders...."

Heard the learned counsel for both sides and perused the record.

The learned counsel for the petitioner would submit that the petitioner's father was a fair price shop dealer of F.P. shop No.B1/421/2004. He expired on 14.10.2020 leaving behind the petitioner, his brother and mother, as legal heirs. Thereafter, the petitioner made applications, dated 19.10.2020 and 24.02.2021, to grant the dealership in his favour in respect of the said shop. Till today, the said applications are not disposed of. It is further submitted that the said applications are required to be considered in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-1) Department, dated 28.02.2014,

Dr.SA,J W.P.No.8735 of 2021 and ultimately, prayed to grant the relief sought for in this Writ Petition, as indicated above.

There is no dispute with regard to the material facts by the other side. Admittedly, no action has been taken on the said applications so far. Much time has been elapsed. By this time, the respondents ought to have disposed of the said applications. In view of the facts and circumstances of the case, it is appropriate to direct the respondents to dispose of the applications, dated 19.10.2020 and 24.02.2021, submitted by the petitioner.

Under these circumstances, the respondents are directed to dispose of the applications, dated 19.10.2020 and 24.02.2021, submitted by the petitioner, in accordance with law and in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS1) Department, dated 28.02.2014, within a period of six (6) weeks from the date of receipt of a copy of this order. 6.

With the above directions, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ______________________ Dr. SHAMEEM AKTHER, J Date: 07th April, 2021.
