HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10809 of 2009 ORDER:

The petitioner states that his father constructed a shop and started business opposite to the bus stand, Sadasivpet, Medak District under the name and style of 'Ramesh Pan Shop' and is presently carrying on the business. He has been paying the encroachment fee to the respondent municipality regularly and paid up to March 2010. While so, when the respondent came to the shop on 01.06.2009 without issuing any notice and following the due process of law and tried to demolish the same, the present writ petition was filed.

This Court by order dated 02.06.2009 directed the respondent not to demolish the shop without following due process of law. The said order has been in operation till today. Even after seven years, no counter-affidavit is filed by the respondent. In view of the same, the interim order dated 02.06.2009 is made as a final order. 3.
