Jupaka Sindhuja v. The State Of Telangana

The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.3477 of 2025 Order:

This Criminal Petition is filed by petitioners/accused Nos.2 to 6, seeking anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), in connection with Crime No.64 of 2025 of Kakatiya University Campus (KUC) Police Station, Hanamakonda, registered for the offences punishable under Section 108 r/w 3(5) of Bharatiya Nyaya Sanhita (BNS).

Heard Mr. Mirza Safiulal Baig, learned counsel for appearing for the petitioners/accused Nos.2 to 6 through video conference and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent/State.

The case of the prosecution is that on 04.02.2025, the Station House Officer, KUC Police Station, received a complaint to the effect that the complainant's son viz., Katkuri Chandu @ Sunny loved one Jupaka Sindhuja and there was a panchayat held before the elders, who decided to perform their marriage, but later, petitioners/accused Nos.2 to 6 changed their opinion and started harassing Sunny stating that they are not acceptable for the marriage proposal and warned him with dire consequences and therefore, Sunny committed suicide by consuming poison and he had also taken a selfie video before committing suicide. Based on the said complaint, aforesaid Crime was registered against petitioners/accused Nos.2 to 6 for the aforesaid offences. 4.

Learned counsel for the petitioners/accused Nos.2 to 6 submits that the petitioners/accused Nos.2 to 6 have

not committed any offence and they were falsely implicated in the aforesaid crime and that the ingredients of Section 108 r/w 3(5) of BNS are not at all applicable to the present case. He further submits that this Court granted anticipatory bail to accused Nos.1, 8 and 9 vide order dated 17.02.2025 in Crl.P.No.1932 of 2025 and to accused No.7 vide order dated 25.02.2025 in Crl.P.No.2308 of 2025 and prays to grant anticipatory bail to the petitioners/accused Nos.2 to 6 as well. He submits that the petitioners/accused Nos.2 to 6 are ready and willing to cooperate with the investigation and also abide by the conditions, which may be imposed by this Court. 5.

Per contra, learned Additional Public Prosecutor submits that the petitioners/accused Nos.2 to 6 are involved in grave offence and the investigation is in progress and if the petitioners/accused Nos.2 to 6 are

granted anticipatory bail at this stage, there is every chance of their influencing the witnesses and interfering with the investigation. Hence, he prays to dismiss this criminal petition.

Having heard learned counsel for the parties and on perusal of the record, it reveals that accused Nos.1, 7, 8 and 9 in the aforesaid crime have already been granted bail and there is no incriminating evidence to prove the involvement of petitioners/accused Nos.2 to 6 in the alleged offence.

In view of the same, this Court is inclined to grant anticipatory bail to the petitioners/accused Nos.2 to 6 subject to the following conditions:

(i) Petitioners/accused Nos.2 to 6 are directed to surrender before the Station House Officer, KUC Police Station, Hanamakonda, within one week from today;

(ii) On such surrender, the Station House Officer of KUC Police Station, Hanamakonda shall release petitioners/accused Nos.2 to 6 on bail on each of them executing personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each for a likesum each to the satisfaction of the said Officer;

(iii) On such release, petitioners/accused Nos.2 to 6 shall appear before the Station House Officer, KUC Police Station, Hanamakonda on every Monday at 11:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required by the police for investigation.

(iv) Petitioners/accused Nos.2 to 6 shall abide by the conditions stipulated under Section 438(2) of the Criminal Procedure Code, 1973/Section 482 of BNSS and shall cooperate with the investigation officer for conclusion of investigation.

Subject to the above directions, the Criminal Petition is allowed. No costs.

As a sequel, miscellaneous petitions, pending if any, stand closed.
