HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9047 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 23 of Karakamukkala Village, Vidapanakal Mandal, Ananthapuram District. While so, based on the inspection report of the Deputy Tahsildar dated 11.11.2015, the second respondent issued show cause notice on 7.11.2015, to which, the petitioner submitted his explanation on 13.11.2015. Dissatisfied with the same, the second respondent passed impugned order dated 11.3.2016 cancelling the authorization of

the petitioner. Aggrieved by the same, the present Writ Petition is filed.

Against the impugned order, appeal lies to the Joint Collector and the petitioner without availing the same, approached this Court, which is not sustainable. In the circumstances, the petitioner is given liberty to file appeal within a period of two weeks from the date of receipt of a copy of the same, and the appellate authority shall dispose of the same, on merits, as expeditiously as possible. Till the appellate authority passes orders either on the stay application or appeal to be filed by the petitioner, operation of the order dated 11.03.2016 passed by the second respondent is stayed.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
