THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.19392 of 2009 ORDER:

Petitioner prays for the following relief:

"... issue a writ or order or direction more particularly one in the nature of writ of Mandamus declaring that the action of the respondent in not fixing the pay of the petitioner properly by restoring the deferred increments and also not paying the difference of arrears in concerned with the proper fixation is bad, arbitrary, illegal, unjust and unreasonable and consequently direct the respondent to pay the same with proper fixation of petitioner's pay scale ..."

2. In WPMP.No.25323 of 2009, the following interim direction was issued: "Notice.

There shall be a direction to the respondents to consider the petitioner's representation dated 12.05.2008 and pass appropriate orders in accordance with law within a period of two weeks from the date of receipt of this order."

3. There is no representation for petitioner.

4. The interim order if considered and appropriate order is passed by respondents, the order passed thereof gives fresh cause of action and the same is required to be challenged independently. In the alternative, if the representation remained unattended, as on date, this Court is satisfied the writ petition can be disposed of by making interim order as final order and further directing the respondents to dispose of the representation, if not already disposed of, within eight (8) weeks from the date of receipt of a copy of this order. Having regard to above circumstances, the writ petition is disposed of by making the interim order as final order. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
