Chandraiah) The sole accused is the appellant herein and he was convicted and sentenced to undergo imprisonment for life for the offences punishable under Sections 302 IPC and for a period of three months for the offence punishable under 309 IPC; for causing the death of his wife and for attempting to commit suicide and both the sentences were made to run concurrently, by the court of the Sessions Judge, Mahila Court, Visakhaptnam by judgment dated 5.11.2009 in S.C.No.76/2005. Challenging the same, the present appeal is filed and the High Court Legal Services Committee engaged an advocate for him from its panel. The learned counsel for the appellant submitted that the appellant had already filed an appeal in Crl.A.No.

1742/2009 by engaging an advocate and hence sought permission to withdraw the present appeal, enabling the appellant to pursue the other appeal filed by him.
