HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.30875 of 2015 ORDER:

Heard Sri G.Rajesh, learned counsel appearing for the petitioner and Sri N. Vasudeva Reddy, learned standing counsel for the respondent-Corporation.

2. The petitioner is the driver in the respondent-Corporation. According to him, he suffered paralysis stroke to his left leg and underwent surgery in the year 2010 in Oxygen Hospitals, Secunderabad. He feels difficulty in walking and other body movements. On his request, the authorities of the Corporation allotted 'out of designation duties' to him. The petitioner states that the Corporation also accorded approval for utilising the services of the petitioner in out of designation duties by allotting him the duties as driver on light vehicle jeep or in bus pass counter. The said duties are being extended from time to time by the 1st respondent, who issued proceedings dated 01.03.2013 and 09.12.2013. Subsequently, proceedings dated 13.04.2015 were also issued extending out of designation duties on medical grounds to the petitioner. The petitioner filed the present writ petition seeking a direction to the 1st respondent to allot out of designation duties to him, as he suffered paralysis with l e f t hemiparesis (left leg).

The petitioner also submitted representations dated 07.09.2015 and 15.09.2015 to the respondentCorporation requesting them to continue his services in out of designation duties.

3. Learned standing counsel for the respondent-Corporation contends that the out of designation duties cannot be extended to the petitioner for an indefinite period.

4. Having gone through the submissions made on either side,

the 1st respondent-Corporation is directed to consider the representations dated 07.09.2015 and 15.09.2015 submitted by the petitioner and pass appropriate orders having due regard to the physical condition of the petitioner, in accordance with the rules, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
