JUDGMENT: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) The appellants are aggrieved by the order dated 01.04.2019 passed by a learned Single Judge, in W.P.No.5038 of 2019, whereby the learned Single Judge has observed that "any appointments made to the post of Junior Panchayat Secretary will be subject to the result of this writ petition".

Briefly, the facts of the case are that the appellants had applied for the post of Junior Panchayat Secretary. They were required to take an objective type papers, namely Paper-1 and Paper-II, based on OMR. According to the appellants, while nineteen questions had incorrect options, fourteen questions were only in the English language, whereas the language opted by them for taking the examination was Telugu. Surprisingly, there was no translation of the questions given in English language into Telugu language. Hence, according to the appellants, they could not possibly answer these fourteen questions. Furthermore, according to the appellants, even on an earlier occasion, they had filed a Writ Petition, namely Writ Petition No.48115 of 2018. By order dated 13.02.2019, this Court had disposed of the said writ petition.

While the respondents in the writ petition were directed to refer the fourteen questions to an Expert Committee, the Expert Committee was directed to decide whether the respondents were justified in printing these fourteen questions in English language without translating them into Telugu language. However, despite the submission of a report of the Expert Committee, the appellants pleaded that the respondents were about the complete the selection process by issuing appointment letters. Hence, the writ petition was filed. Mr. S. Rahul Reddy, the learned counsel for the appellants, pleads that the appellants have been fighting an uphill battle.

Instead of granting stay and preventing the respondents from appointing the selected candidates, the learned Single Judge has merely stated that the selection would be subject to the decision of the writ petition. Therefore, the impugned order deserves to be interfered with.

Heard the learned counsel for the appellants. The learned counsel for the appellants is unjustified in claiming that the appellants have not achieved anything, despite having filed the earlier writ petition. After all, it is only at their behest that this Court had directed the constitution of an Expert Committee to examine the grievances of the appellants.

Moreover, the impugned order is an innocuous one. And it is, in fact, in favour of the appellants themselves. For, the learned Single Judge has made it abundantly clear that any appointment made on the basis of the selection would be subject to the final outcome of the writ petition. Therefore, the appellants cannot claim that they are aggrieved by the said order. Hence, the present appeal is highly misplaced. For the reasons stated above, this Court does not find any merit in the present appeal; it is hereby dismissed. There shall be no order as to costs.
