THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.2381 OF 2018 ORDER:

This petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C.") to enlarge the petitioner on bail in S.C.No.281 of 2017 on the file of VI Additional District and Sessions Judge (Fast Track Court) Tirupathi, registered for the offence punishable under Sections 395, 396 and 201 of Indian Penal Code.

The petitioner allegedly committed offence punishable under Sections 395, 396 and 201 of I.P.C. and the entire investigation is completed and police filed charge sheet before the concerned Magistrate, who in turn committed the case to the Sessions Division by following the procedure under Section 209 of Cr.P.C. and it is numbered as S.C.No.281 of 2017.

It is the contention of the petitioner that he is in judicial custody from 05.03.2013 in connection with various crimes and acquitted in some of the cases and some other cases are pending for trial before the Courts.

The petitioner appears to have involved in various cases of robbery etc., and appears to be habitual offender and in case the petitioner is enlarged on bail, there is possibility of committing similar offences.

Taking into consideration of facts and circumstances of the case and acquittal in some of the cases, I deem it appropriate to direct the concerned Sessions Judge to decide the S.C.No.281 of 2017 within Six (6) months from today in accordance with law while holding that it is not a fit case to grant bail to the petitioner.

In the result, the petition is dismissed. However, the VI Additional District and Sessions Judge (Fast Track Court) Tirupathi is directed to dispose of S.C.No.281 of 2017 within six (6) months from the date of receipt of a copy of this Order. The miscellaneous petitions pending, if any, shall also stand closed.
