THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6359 of 2018 Order:

This Writ Petition is filed challenging the action of the second respondent in registering the Cancellation of Gift Settlement Deed bearing document No.4341 of 2004, dated 05.07.2004, canceling the registered Gift Settlement Deed under document No.3353 of 2004, dated 24.05.2004, without issuing any notice to the petitioner. The relevant rules under the Registration Act, 1908, were amended with effect from 02.06.2014 and unilateral execution of cancellation deeds is not now possible, however with regard to maintainability of the Writ Petitions challenging the action of the registering authorities that took place before the said amendment on 02.06.2014 was considered by me in P. Veda Kumari v. Sub-Registrar, Banjara Hills, Hyderabad1, and I held that the Writ Petitions are not maintainable and the Writ Petitions were disposed of on the point of law only without going into the merits of the case.

Following the said judgment, this Writ Petition is also dismissed holding that the present Writ Petition is not maintainable. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
