D. Amarender Reddy v. The State Of Telangana
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos.7683 & 7684 OF 2019 Date:12.04.2019 W.P.No.7683 of 2019 Between:
K. Hari Prasad Rao, S/o. K. Rama Rao, aged 51 years, R/o. Plot No.95, Jubilee Hills, Hyderabad and others .. Petitioners And The State of Telangana, rep., by its Secretary, Revenue (Stamps & Registration) Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos.7683 & 7684 OF 2019 COMMON ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. 2.
In these Writ Petitions, the petitioners allege that sale deed presented by them was not received by the Joint Sub-Registrar, Ranga Reddy District, on the ground that the document does not contain 'No Objection Certificate' (NOC) from the Urban Land Ceiling Authority.
3.
As fairly submitted by learned counsel for the petitioners, so far, the document is not even presented before the registering authority. He further submits that though NOC is not required, the Sub-Registrar is refusing to receive the document. This contention cannot be appreciated.
4.
In W.P.No.7670 of 2019, a similar plea was raised and it was contended that document was not processed on the ground that NOC obtained from the Urban Land Ceiling Authority was not presented. In the said case, it is seen that the same officer received the document and kept the same pending. Thus, it cannot be said that the Sub-Registrar is refusing to receive the document. However, petitioners have not filed any proof of paying stamp duty, as required, to show their bona fides. Thus, the Court is not inclined to entertain the Writ Petitions. 5.
The Writ Petitions are accordingly dismissed leaving it open to the petitioners to present the subject document before the
Sub-Registrar concerned with the requisite stamp duty. It is needless to observe that as and when the document is presented by the petitioners, the registering authority shall receive and process the same as expeditiously as possible. There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed.
