RAM REDDY Advocate for the Petitioner and the Assistant PUBLIC PROSECUTOR for the Respondent, the Court made the following.

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A3 seeking to grant anticipatory bail in the event of his arrest in Cr.No.39 ot 2021 on the file of Pulkal Police Station, Sangareddy District, registered for the offence punishable under Section 306 read with Section 34 lPC.

Heard learned counsel for the petitioner/A3, learned Assistant Public Prosecutor appearing for the respondenlState and perused the record.

Learned counsel for the petitioner/A3 submits that the petitioner is working as Additional Program Officer on EGS Works in the Office of the Mandal Parishad Development Office,Pulkal Mandal, Sangareddy District and that the deceased was the Panchayath Secretary of l\zlinpur Gram Panchayath. He further submits that the deceased was on leave from 21 .02.2021 to 06.03.202'1 and during the period lrom 22.02.2021 lo 27.02.2021, the EGS work was done on the l\rlinor lrrigation Tank of Minpur Village and in the absence of the Panchayat Secretary, on his instructions, Muster Rolls were maintained by a Senior N,4ate of the EGS Workers, however, the deceased has submitted his resignation letter to the MPDS on 03.03.
2021 mentioning that due to personal reasons, he is resigning, but the same was not accepted by the MPDO, and convinced him to withdraw the said resignation, and then, the deceased joined his duties on 08.03.2021. He further submits that the deceased was absconding from his duties since 06.O3.2O21 onwards and in his absence, the higher officials have deputed another Technical Assistant Mr. Sathish and thereafter, the said Technical Assistant has submitted M.B.books to the petitioner on 15.03.
I works Bank accounts, but the deceased committed suicide on 17.O3.2021 and hence, there is absolutely no negligence on the part of the petitioner in performing his duties. He further submits that the name of petitioner is not mentioned in the FIR and only basing on false allegations, the petitioner has been implicated in the present case. He also submits that the petitioner is a law abr'ding citizen and he has not involved in any criminal cases earlier to this crime and .he is ready to abide by any condition that may be imposed by this Court in the event of his enlargement on anticipatory bail.

Learned Assistant Public Prosecutor opposed the anticipatory bail application of petitioner, but conceded to the fact that the petitioner's name has not been mentioned in the FlR.

Having regard to the facts and circumstances and looking into the nature of allegations leveled against the petitioner/A3 and even in the suicide note, there are absolutely no allegations whatsoever against the petitioner, without delving into the merits of the matter, I am inclined to grant anticipatory bail to the petitioner on some conditions. 6.
The Criminal Petition is accordingly allowed and the petitioner/A3 is granted anticipatory bail subject to the following terms and conditions: (i) The petitioner/A3 is directed to surrender before the Station House Officer, Pulkal Police Station, Sangareddy District, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioner/A3 on bail on his executing a personal bond to the tune of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for the like sum each to his satisfaction.
(ii) On such release, the petitioner/A3 shall abide by the conditions stipulated under Section 438(2) Cr.P.C. ---2
/ Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
