CVNR,J & MSKJ,J W.A.No.334 of 2017 22.08.2017 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ appeal is filed against an ad interim order directing the appellants to consider the case of respondent No.1 for promotion to the post of the Assistant Divisional Engineer (Electrical), without reference to the pending criminal case.

A perusal of the order under appeal shows that while ordering notice in W.P.M.P.No.27795 of 2016 in W.P.No.22609 of 2016, the learned Single Judge has granted the aforementioned interim order. 3.

Mr.Jakir Ali Danish, learned standing counsel for the Telangana State Northern Power Distribution Company Limited appearing for the appellants, has submitted that in W.P.No.15203 of 2016, wherein interim order similar to the order under appeal was passed, a learned Single Judge of this Court has vacated the said interim order.

In view of the above fact, there is no reason for the appellants to question the ad interim order instead of filing a counter-affidavit and moving an application seeking vacation thereof, as was done in W.P.No.15203 of 2016. 5.

In the above view of the matter, without adjudicating on the correctness or otherwise of the order under appeal, the Writ Appeal is dismissed, with liberty to the appellants to file an application for vacating the ad interim order. 6.
