HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.1197 OF 2017 ORDER:

Heard before admission.

If at all there is a licensor or licensee or landlord tenant or bail or bailee relation between the petitioner and the person who stored the so-called spurious chilly powder, it is a matter between them, purely a civil dispute to decide elsewhere. It is not even the application either within the provision of Section 451 or 457 or even under Section 458 and 459 Cr.P.C. What the petitioner claims, the chilly powder occupied in his godown by the accused licensor/licensees that to be destroyed or to be shifted, for which, he cannot approach the court invoking the provision.

Having regard to the above, without going into the other merits, the dismissal of the application no way requires interference. It is for the person who stored if at all to be asked by the petitioner who let out or permitted, to vacate before another forum.

Accordingly and in the result, this Criminal Revision case is dismissed. Miscellaneous petitions pending, if any, in this case shall stand closed.
