This petition is filed under Section 407 Cr.P.C., seeking to transfer C.C.No.548 of 2010 on the file of Judicial First Class Magistrate, Tungaturthi, Nalgonda, to the Court of the Special Judge for SCs & STs (POA) Act, Nalgonda.

Heard learned counsel for the petitioner and learned Public Prosecutor for the first respondent-State. None appeared for the second respondent in spite of service of notice. 3.

Learned counsel for the petitioner submits that the petitioner/A5 filed a counter case with regard to the same incident and the same is pending before the Special Judge for SCs & STs (POA) Act, and hence, it would be just and proper to try both the cases together.

A perusal of the FIRs in Cr.Nos.85 and 87 of 2010 on the file of Noothankal Police Station, Nalgonda District, would show that the incident occurred on the same day. Hence, this Court finds that transfer of C.C.No.548 of 2010 on the file of the Judicial First Class Magistrate, Tungaturthi, Nalgonda, to the Court of the Special Judge for SCs & STs (POA) Act, Nalgonda, where Cr.No.87 of 2010 is pending, would serve the ends of justice.

In the result, the Transfer Criminal Petition is allowed, transferring C.C.No.548 of 2010 on the file of the Judicial First Class

Magistrate, Tungaturthi, Nalgonda, to the Court of Special Judge for TR,J Tr.Crl.P. No.146 of 2013 SCs & STs (POA) Act, Nalgonda. Miscellaneous applications, if any, pending in this petition shall stand closed.
