Heard the learned counsel for the petitioners. None appears for the respondents.

The case of the petitioners is that 1st petitioner was granted DForm patta for an extent of Ac.2.49 cents in Sy.Nos.769/1 to 7, 2nd petitioner was granted D-Form patta for an extent of Ac.2.45 cents in Sy.Nos.795/2 & 3, 3rd petitioner was granted D-Form Patta for an extent of Ac.1.96 cents in Sy.No.794/3, and the 4th petitioner was granted D-Form patta for an extent of Ac.2.02 cents in Sy.Nos.770/1 &

2. All these lands are situated in Vaivaka village, Mudinepalli Mandal of Krishna District. The petitioners were issued D-Form pattas in the year 1992 by the 1st respondent, and since then they were in possession and enjoyment of their respective lands. The petitioners were also issued pattedar passbooks and title deeds. While so, in the month of may, 2005, the respondents tried to interfere with the possession and enjoyment of the lands of the petitioners and they were asked to vacate the same. The petitioners submitted a representation to the 1st respondent-Mandal Revenue Officer, Mudinepalli Mandal requesting him not to take any action for cancellation of D-Form pattas issued in their favour. However, without passing any orders and without issuing any notice, the respondents tried to interfere with the possession of the lands of the petitioners, and hence the present writ petition was filed.

No counter affidavit was filed by the respondents even after 9 years.

In the circumstances, the Writ Petition is disposed of, directing the respondents not to interfere with the possession of the lands, granted to the petitioners under D-Form pattas, without issuing any notice and without following due process of law. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed in consequence.
