THE HON'BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.3510 of 2025 ORDER:
This criminal petition is filed by the petitioner/suspected under Sections 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS) seeking anticipatory bail in Crime No.22 of 2025 on the file of Adavi Mutharam Police Station, Jayashankar Bhupalpally District, registered for the offence punishable under Section 194 of BNSS.

The case of the prosecution is that one Korra Satyam, who is the father of the deceased, lodged a complaint on 04.03.2025, wherein it is stated that his daughter, namely, Sindhuja, who is studying Intermediate at Hanamkonda, came to his house on 26.02.2025 and stated that one J. Aniruth is harassing her physically and mentally through his Mobile No.8919321032, due to which she consumed poison and died on 04.03.2025. Basing on the said complaint, the present crime was registered for the offence under Section 194 BNSS.

Heard Sri M. Nagendra Babu, learned counsel for the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent.

Learned counsel for the petitioner submits that the petitioner has not committed the offence and in the first information report his name was not mentioned as an accused. He further submits that the petitioner has not instigated the deceased to commit suicide. Basing on the allegations made in the complaint, if the section of law is altered to Section 108 BNS, the ingredients of the said Section will not applicable to the petitioner and that as on date, the petitioner is not made as an accused. He further submits that the petitioner is a student and studying degree first year in Hanamkonda and he has to appear for the examinations, which are going to be conducted in the month of April, 2025, and that the petitioner is ready and willing to cooperate with the investigation and also abide by the conditions that are going to be imposed by this Court. He further submits that unless the petitioner is granted anticipatory bail, he will be put to irreparable loss.

Per contra, learned Additional Public Prosecutor submits that investigation is not yet completed and if the petitioner is enlarged on bail, there is every chance of influencing the witnesses and interfering with the investigation. 6.
Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that basing on the complaint lodged by the complainant, the present crime was registered for the offence under Section 194 BNS on 04.03.2025. The petitioner is a student and studying degree first year in Hanamkonda and he has to appear for the examinations which are going to be held in the month of April, 2025. It is not disputed by the learned Additional Public Prosecutor that as on date, the section of law is not altered and the petitioner is not made as an accused in the present crime 7.
Taking into consideration the facts and circumstances of the case, this Court is inclined to grant anticipatory bail on the following conditions:
(1) The petitioner/suspected is directed to surrender before the Station House Officer, Adavi Mutharam Police Station, Jayashankar Bhupalpally District, on or before 26.03.2025.
(2) On such surrender, the Station House Officer shall release the petitioner on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousands only) with two sureties for a like sum each to the satisfaction of the said officer.
(3) On such release, the petitioner shall appear before the Station House Officer, Adavi Mutharam Police Station, Jayashankar Bhupalpally, for the purpose of investigation as and when required by the police.
(4) The petitioner shall abide by the conditions stipulated under Section 438(2) of the Criminal Procedure Code, 1973/Section 482 of BNSS.

Subject to the above directions, the criminal petition is allowed. No costs.
Pending miscellaneous applications, if any, shall stand closed.
