THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.693 of 2011 JUDGMENT:

This appeal is filed, under Section 100 CPC, assailing the judgment and decree dated 18.01.2011 in A.S.No.240 of 2005 on the file of IV Additional District Court, Nellore, wherein whereby the decree and judgment dated 18.10.2005 passed in O.S.No.197 of 1998 on the file of I Additional Junior Civil Judge Court, Nellore, dismissing the suit filed by the plaintiff for declaration and consequential perpetual injunction, was confirmed.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal with a liberty to avail the remedies available to him under law.

Permission as sought for is accorded.
