G.Rangandham v. The Depot Manager,
HON'BLE SRI JUSTICE R.KANTHA RAO and HON'BLE SRI JUSTICE DR B.SIVA SANKARA RAO W.A.No.277 of 2016 ORDER: (Per Hon'ble Sri Justice R.Kantha Rao) This appeal is directed against the order dated 29.03.2016 passed by the learned Single Judge of this Court in W.P.No.10164 of 2016.
The writ petitioner is the appellant herein. He is driver in the respondent-Corporation. Charge was framed against him alleging that he caused an accident by his rash and negligent driving and hence, he was kept under suspension. Challenging the order of suspension, he filed W.P.No.10164 of 2016. When the writ petition came up for consideration, learned Single Judge of this Court while declining to interfere with the order of suspension, directed the respondentCorporation to complete the enquiry within a period of one month and pass final orders. Feeling aggrieved, the present Writ Appeal has been preferred by the appellant.
Upon hearing the learned counsel on either side, we are of the view that the view taken by the learned Single Judge is reasonable, which requires no
interference in this appeal.
Therefore, while disposing of the writ appeal, upon considering the order passed by the learned Single Judge, it is directed that the respondentCorporation shall complete the enquiry and pass appropriate final orders in terms of the order passed by the learned Single Judge in W.P.No.10164 of 2016. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
