HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.221 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1858 of 2013 from the file of Family Court, Ranga Reddy District at L.B.Nagar and transfer the same to Senior Civil Judge, Mangalagiri, Guntur District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 08.08.2012 at Gateway Hotel, Vijayawada as per Hindu Sastras and Customs and marriage was consummated. She stated that as respondent is addicted to drugs and due to his contacts with several ladies, she came back to her parents' house at Vijayawada and that she filed a case against respondent and his family members which is registered as Crime No.785 of 2012 for an offence under Section 498-A IPC and on investigation police filed charge sheet and the same is numbered as C.C.No.1203 of 2013 on the file of II Additional Chief Metropolitan Magistrate at Vijayawada. She further stated that she filed MC No.76 of 2012 before Additional Junior Civil Judge, Mangalariri and that the respondent is contesting both the cases.

She stated that as a counter blast the respondent filed O.P. before the Family Court, Ranga Reddy District for divorce and that she is a house wife and depending on her old aged parents and she has been residing at Mangalagiri.

3. This Court permitted the petitioner to take personal notice to respondent through registered post with acknowledgment due. Petitioner in compliance of the said order sent a notice to the respondent on 06.05.2014 and the said notice was returned with an endorsement not claimed. The notices sent through Court also returned with an endorsement party is out of station and left without instructions.

4. Heard advocate for petitioner.

5. It is submitted that the respondent herein is attending Courts at Vijayawada and Mangalagiri for the criminal case and maintenance case, no prejudice will be caused if O.P. is transferred to Mangalagiri, where the petitioner is residing.

6. Perused the affidavit filed in support of the petition.

7. Considering the reasons stated in the affidavit and also considering the convenience of the wife, O.P.No.1858 of 2013 is withdrawn from the file of Family Court, Ranga Reddy District at L.B.Nagar and transferred to Senior Civil Judge, Mangalagiri for disposal in accordance with law.

8. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. ___________________ S. RAVI KUMAR, J Date: 02-03-2016 kvrm
