THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.28030 OF 2015 ORDER:
The prayer sought for in the writ petition is as under: " to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No. 6 in harassing the petitioner by involving himself into the civil disputes between the petitioners and the 7th respondent as illegal and unconstitutional and consequently direct the respondent No. 6 not to harass the petitioners in any manner either by calling them to Mydukur U/ g Police Station or by asking them to come for settlement with 7th respondent."
The main grievance of the writ petitioners is that the respondent No.6 is harassing them by interfering in civil disputes between the petitioners and the respondent No.7. During the course of arguments, the learned Government Pleader appearing for the respondents 1 to 5 placed on record the written instructions dated 08.09.2015 issued by the Sub-Divisional Police Officer, Mydukur Sub-Division, YSR Kadapa District. The said instructions are placed on record. A perusal of the said instructions would indicate that the petitioners are involved in Crime No.110 of 2015 for the offences under Sections 420, 435 r/ w 34 I.P.C. on the file of Mydukur U/ g Police Station. Since the signatures of the petitioners are required for sending to an handwriting expert, a notice under Section 41-A of Cr.P.C. dated 04.04.2015 was served on them. However, the petitioners, instead of co-operating with the investigating agency, filed the present writ petition with the baseless allegations. Except the registration of the above said
crime against the petitioners, the respondent-police never interfered with the civil disputes or personal life and liberty of the petitioners at any point of time.
Taking the above said submission into consideration, this Court is of the opinion that no further orders are required in this Writ Petition and the same is accordingly closed. No costs.
