THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7188 OF 2015 ORDER:
This petition is filed by the petitioner-accused No.8 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.57 of 2014 on the file of the Judicial Magistrate of First Class, Palamaner, Chittoor District.
Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 384, 403, 405, 406, 408, 409, 417, 418, 419, 420, 426, 467 and 468 r/w 34 IPC. The petitioner is the Junior Accounts Officer of Shriram City Union Finance Limited, Palamaner. It is alleged that A1 to A3 in connivance of A4 and A5 approached A6 and pledged impure gold ornaments and obtained gold loans with excess amount than the market value. It is alleged that A4 to A8 colluded with A1 to A3 and furnished false information regarding genuineness of gold, weight of gold and misappropriated the funds of Sriram City Union Finance Limited.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of petitioner-A8 before the trial Court is dispensed with except on the date of framing of charges, if any, and on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment in the above C.C. The petitioner is directed to be represented by his Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
