HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.2890 OF 2004 JUDGMENT:

The appeal is preferred against order dated 30th April, 2003 in O.P.No.182 of 1997 on the file of Motor Accidents Claims Tribunalcum-District Judge, Nizamabad. The Tribunal granted Rs.77,597/- as compensation as against claim of Rs.1,00,000/-. Not satisfied with the quantum, claimant preferred the present appeal.

As seen from the proceeding sheet, every time, the matter is being adjourned on the request of appellant's counsel. From 4-3-2015, this matter is adjourned to 11-3-2015 making it clear that no further adjournment will be granted. On 11-3-2015, as there was no representation for the appellant, it is directed to be posted to 18-32015 under the caption of 'dismissal'. On 18-3-2015, advocate for appellant sought for time and on his request, dismissal caption is deleted and directed to be posted next week. Now it is listed today i.e., 25-3-2015. In spite of granting adjournment and deleting from the caption of dismissal, that too, on the request of appellant's counsel, no interest is evinced in proceeding with the case. Today, again a request is made for adjournment without assigning any reason. Therefore, I am not inclined to grant any further time and the appeal is dismissed for non-prosecution.
