THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.32162 OF 2010 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, wherein the following prayer is made:
"...to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents in violating the fundamental rights of the petitioner by way of illegal confinement and for harassing and torturing the petitioner though no cases are pending against him as illegal, arbitrary and violation of fundamental rights under Article 21 of constitution of India and pass such order or orders....."

The grievance of the petitioner is that though no cases are pending against him, he was illegally confined and harassed by the respondent police.

Though it is alleged by the petitioner that there was illegal confinement and harassment by the respondent police, there is no record to substantiate the same. Even if the petitioner is aggrieved by his alleged illegal confinement and harassment by the respondent police, he can take legal recourse, in accordance with law.

With the above observation, this Writ Petition is disposed of. No costs.
