O R D E R

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner/accused No.7 in Crime No.07 of 2026 of Thangallapally Police Station, Rajanna Sircilla District, registered for the offence punishable under Section 310 (2) of the BNS.

Heard Sri V.S.R.M.V.Prasad, learned counsel for the petitioner/A.7 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondentState. 3.

The case of the prosecution is that the de facto complainant lodged a complainant on 10.01.2026 wherein it is stated that on 10.01.2026 at about 4:00 AM after loading 8 quintals of hair into Mahindra Bolero pickup vehicle bearing No.TS-21-T-9000, the complainant along with his driver started towards Hyderabad side with the said load and when they reached Thangallapally they parked the vehicle and in the meantime one person came from Ertiga vehicle, which was parked at a short distance, to the middle of the road and signaled to stop using a torch light. Thereafter A.1 to A.5 came out from the said vehicle by wearing masks and threatened the complainant to kill him and took Rs.5,000/- from his pocket forcibly and pick up the loaded Mahindra Bolero. The worth of 8 quintals of hair load in the vehicle is worth Rs.16.00 lakhs and the vehicle cost is Rs.4.00 lakhs. Hence, the complainant lodged a complaint to take necessary action against the

accused persons. Basing on the same, police registered a case for the aforesaid offences.

Learned counsel for the petitioner submits that the petitioner is innocent of the offence alleged against him; that the petitioner was not present at the scene of offence and he has been falsely implicated in the present case; that the they seized total property from the scene of offence arrested A.1 to A.5 and therefore, custodial interrogation of the petitioner is not required; that except the present case, no other cases are pending against the petitioner and hence he prays to grant Anticipatory Bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and contended that the offence alleged against the petitioner is serious in nature; that the investigating is still pending and at this stage, the petitioner is not entitled for grant bail and hence, he prays to dismiss the petition.

Having regard to the submissions made by both the parties and on perusal of the material on record, it shows that accused Nos.1 to 5 were arrested at the scene of offence immediately after seizure of the alleged property

and thereafter the crime property was recovered, this Court is inclined to grant Anticipatory bail to the petitioner subject to the following conditions:

(i) The petitioner shall surrender before the Station House Officer, Thangallapally Police Station, Rajanna Sircilla District, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for a like sum each.

(ii) After release, the petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required. (ii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
