THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.4974 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner / Accused No.4 in C.C.No.527 of 2016 on the file of the Court of the XIII Additional Chief Metropolitan Magistrate, Hyderabad.

At the time of arguments, the only relief, which the learned counsel for the petitioner, has sought is that the presence of the petitioner/accused No.4 before the trial Court may be dispensed with on each and every date of adjournment. In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

There is no dispute with the regard to the identity of the petitioner, who is accused No.4 and even if her presence is dispensed with, no prejudice will be caused to second respondent herein.

Having regard to the facts and circumstances of the case, the presence of the petitioner, who is accused No.4 in C.C.No.527 of 2016 on the file of the Court of the XIII Additional Chief Metropolitan Magistrate, Hyderabad, is dispensed with on each and every date of adjournment. However, she shall appear before the trial Court as and when her presence is so required.

With the above observations, this Criminal Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. ___________________________ T. SUNIL CHOWDARY, J.
