HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 27427 OF 2017 ORDER:
This writ petition is filed challenging Memo No.9545/Vig-II(1)/2008, dated 27.03.2017 issued by the 1st respondent, wherein the review petition filed by the petitioner was rejected.
Learned counsel for the petitioner submits that the review petition was disposed of without considering the clarification issued by the Engineer-in-Chief (Public Health) on 20.01.2017.
He submits that though aforesaid clarification is brought to the notice of the respondent, the impugned order is passed erroneously.
Learned Assistant Government Pleader for Services submits that when once the review petition is disposed of, the question of reviewing the review order does not arise and petitioner would have challenged the order passed in the review petition.
Learned counsel for the petitioner submits that the punishment imposed for a period of two years expires by 08.10.2017, the case of the petitioner can be considered thereafter.
Having regard to the facts and circumstances of the case, this Court is not inclined to interdict with the impugned order dated 27.03.2017. However, since it is stated
that period of punishment imposed on the petitioner expires by 08.10.2017, the respondents are directed to consider the case of the petitioner for future promotions as and when decision is taken for effecting promotion to the next category, as per Rules.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
