THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.34616 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action of the respondents 1 to 3 in not calling for tenders for transportation of paddy in Adilabad District for the crop year 2016-17as illegal and arbitrary.

Heard Mr. T.Mahender Rao, learned counsel for the petitioner and Mr.A.Jagan, learned standing counsel for Telangana Civil Supplies Corporation, representing respondents 1 to 3.

The petitioner is one of the stage I transport contractors. The respondent corporation allotted transport contract work in favour of the petitioner for the years 2013-14 and 2014-15. The respondent corporation allotted the transport contract work to the 4th respondent for the year 2015-16. The petitioner submitted a representation to the 1st respondent on 06-10-2016 with a request either to issue a notification or to allot transport contract work to the petitioner for the year 2016-17. For one reason or the other, the 1st respondent has not disposed of the representation of the petitioner. The 1st respondent is the competent person either to issue notification or to allot transport contract work in accordance with law.

At the time of arguments, the only relief sought for by the learned counsel for petitioner is to direct the 1st respondent to dispose of the representation of the petitioner, dated 06-10-2016 as early as possible. Learned standing counsel also consented for the same.

In view of submission made by both counsel, this Court is not inclined to go into the merits of the case. 6.
Having regard to the facts and circumstances of the case and also submissions made by both counsel, the 1st respondent is directed to dispose of the representation of the petitioner, dated 06-10-2016 in accordance with law as expeditiously as possible preferably within a period of one month from the date of receipt of a copy of this order. 7.
Accordingly, Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
