THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28250 of 2016 ORDER:

Heard the learned counsel for petitioner, the learned Government Pleader for Social Welfare (TS) for respondent No.1 and the learned Standing Counsel for respondents 2 and 3.

2. The petitioner was appointed as a Trained Graduate Teacher on 08.02.1991 and was promoted as Post Graduate Teacher on 25.12.2006. He was further promoted as Junior Lecturer on 26.02.2009 and posted at Rajapet, Nalgonda District. He was transferred to Mattampalli in the month of July, 2009.

While so, when he was transferred from Mattampalli, Nalgonda District to Narayanakhed, Medak District, he filed W.P.No.26018 of 2016 and this Court granted status-quo order on 04.08.2016. He reported to duty on 06.08.2016 and performed duties upto 18.08.2016. Though he applied for leave from 31.07.2016 to 05.08.2016 including general holidays on 01.08.2016 and 02.08.2016, without considering the leave application when he was placed under suspension for his alleged unauthorized absence from 31.07.2016 to 05.08.2016, the present writ petition is filed.

3. A reading of the impugned order of suspension shows that it was passed on a report of the third respondent dated 06.08.2016. On the basis of the said report, the second respondent kept the petitioner under suspension in public interest pending enquiry.

4. In view of application of mind by the second respondent based on the report/complaint of the third respondent, this Court is not inclined to interfere with the order of suspension. But, since the allegation relates to unauthorized absence from 31.07.2016 to 05.08.2016 which is disputed by the petitioner, this Court is inclined to dispose of the writ petition with a direction to the respondents to complete the pending departmental proceedings as expeditiously as possible, but not later than six weeks

from the date of receipt of a copy of this order. It is needless to observe that the petitioner shall cooperate with the completion of the enquiry.

5. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
