THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29997 OF 2017 ORDER:

This Writ Petition is filed complaining that there is no progress with respect to Crime No.153 of 2017 of Meerpet Police Station, dated 16.03.2017.

2. Learned Government Pleader, on instructions, submits that the investigation is almost complete and prima facie case is established against the accused in the said crime. However, on account of pendency of W.P.No.12131 of 2017 and in view of the interim orders granted on 06.04.2017 in the said Writ Petition, the Investigating Officer is unable to proceed further.

3. It may be noticed that the order, dated 06.04.2017, in W.P.No.12131 of 2017 is only in relation to stay of arrest and not to take any coercive steps against the petitioners therein, who are the accused in the aforesaid crime. The said interim order cannot be construed as impeding filing of charge sheet, if the investigation reveals committing of offence.

4. In those circumstances, by making it clear that the order, dated 06.04.2017, cannot be a hindrance to respondent Nos.3 and 4 to file charge sheet, the Writ Petition is disposed of directing respondent Nos.3 and 4 to take necessary steps as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt

of a copy of this order. However, the disposal of this Writ Petition shall be subject to any further orders that may be passed in W.P.No.12131 of 2017.

5. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ___________________________ CHALLA KODANDA RAM, J September 21, 2017 MD
