THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.2648 of 2009 ORDER:

The petitioner challenges the order dated 05-01-2009 in I.A.No.291 of 2008 in I.D.No.10 of 2007. Through the order impugned in the writ petition, the Labour Court directed the petitioner herein to produce the enquiry statement of Sri S.K.Murthy in his enquiry to know the reasons for the incident, dated 08-09-2005.

The writ petition is dismissed for default against 2nd respondent for non-compliance of conditional order dated 11-12-2012.

After lapse of three and half years, it appears that no steps are taken to rectify the defect. Since the writ petition is dismissed against the contesting respondent, the prayer cannot be considered.

Accordingly, the writ petition is dismissed. It is open to the petitioner, if so advised, to file appropriate petitions for restoration as well as setting aside the default order against 2nd respondent. No order as to costs.
