ORDER

Challenging the inaction of respondent Nos.2, 3, 4 & 5 in investigating into the offences committed by the 6th respondent, the present writ petition is filed.

Learned Government Pleader for Home, on written instructions, submits that based on the complaint given by one Bathala Malyadri, a case in Cr.No.101 of 2014 was registered by the Station House Officer, Kondapuram Police Station, for the offences punishable under Sections 324, 323, 506, 290 read with 34 IPC and Section 3 (1) (x) of Schedules Casts & Scheduled Tribes (Prevention of Atrocities) Act, 1989, against the petitioners herein, who were arrayed as A1 & A6 and four others. He further submits that charge sheet was filed before the Additional Judicial First Class Magistrate, Kavali, which was numbered as PRC No.26 of 2016 and the same is pending. The 1st petitioner sent a representation on 28.3.2015 to the Director General of Police, the Superintendent of Police and the District Collector on 27.3.

2015 stating that the 6th respondent telephoned to the 2nd petitioner to support the complainant's version in Cr.No.101 of 2014 and if he does the same, his name will be deleted from the said crime as A6. In that connection, the petitioner sought action against the 6th respondent.

Superintendent of Police, SCs & STs Cell-1, Nellore, who after examining the same and conducting necessary enquiry, submitted a report on 3.8.2015 to the Superintendent of Police, SPS Nellore stating that the 6th respondent has not threatened the 2nd petitioner. Since charge sheet was already filed, no action was taken on the representation of the petitioners dated 28.3.2015 against the 6th respondent.

In view of the above facts, no further orders are necessary in the present case.

Accordingly, the Writ Petition is closed. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 8th February, 2017 rkk[
