HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.17142 of 2014 in Crl.P.No.16014 of 2014 and Criminal Petition No.16014 of 2014 COMMON ORDER:

De-facto complainant and her counsel Sri Chikkudu Prabhakar are present. Accused and their counsel Sri T.Sujan Kumar are present.

On the report give by defacto complainant the police of WPS, CCS, Hyderabad registered Cr.No.542 of 2013 against the accused for the offences under Sections 498A and 406 IPC and Sections 4 and 6 of Dowry Prohibition Act and investigation is reported to be pending.

While so, now the parties submitted that at the intervention of elders they have amicably settled their disputes and defacto complainant and A1 proposed to take divorce and filed OP No.1221 of 2014 on the file of Family Court, City Civil Court, Hyderabad and the same is pending. The maintenance claim of defacto complainant and her son is also taken care of where A1 agreed to pay Rs.11 lakhs to the defacto complainant and her son towards their maintenance and he is going to pay the amount at the time of obtaining mutual divorce in OP No.1221 of 2014 and in view of it, defacto complainant has no objection for quashment of proceedings in Cr.No.542 of 2013 and therefore, parties may be permitted to compound the offence and quash the proceedings in the interest of justice.

Having regard to the above submission of the parties and considering the fact that it is a matrimonial matter and the parties have amicably settled their disputes and no useful purpose will be served if they are driven to trial, and following the decision reported in Gian Singh v. State of Punjab and another (2012) 10 SCC 303) this petition is allowed and permission is accorded to the parties to compound the offence and compromise is recorded in terms of joint memo and proceedings in Cr.No.542 of 2013 of WPS, CCS, Hyderabad are hereby quashed.

In the result, the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
