Mekala Anil Kumar v. The State Of Ap.,
THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8838 OF 2016
O R D E R
This criminal petition is filed under Section 482 of Cr.P.C. to quash the proceedings in C.C.No.422/2015 on the file of Judicial First class Magistrate, Kothapeta, registered against the petitioners, who are A-1 to A-4, for the offences punishable under Sections 420, 498-A and 506 read with 34 IPC. Heard the counsel for the petitioners/accused and the learned Additional Public Prosecutor, representing the State. Specific allegations were made against the petitioners in the complaint. The truth or otherwise of the allegations can only be decided during the course of trial. This court is not supposed to make a roving enquiry into the allegations made in the charge sheet. I see no grounds to quash the proceedings at this stage.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to proceed with the trial and dispose of the same within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioners 2 to 4 / accused 2 to 4 on each and every date of hearing, except required for any specific purpose. However, petitioner No.1 / accused No.1 shall appear before the trial court. Pending miscellaneous applications, if any, shall stand closed. No costs.
