THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2402 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.264 of 2017 on the file of the Station House Officer, Asifnagar Police Station, Hyderabad, registered for the offences punishable under Sections 448, 380 and 506 r/w 34 IPC.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

As per the report lodged with the police, dated 28.10.2017, when the de facto complainant went to his office on 28.09.2017, he found that his office locks were broken and on enquiry conducted by him with the neighbours, he came to know that the petitioners got broken the locks and entered into the office of the de facto complainant and stolen valuables there from including cash of Rs.5,70,000/-. Further, there are also allegations of stealing of cheque books and land documents etc., The crime is at a pre-mature stage. There are also other allegations. Pendency of civil suit between the parties is not a ground to quash the proceedings in this crime. Truth or otherwise of the allegations made in the report are required to be investigated. The continuation of investigation is not an abuse of process of law. The petition is devoid of merit and is liable to be dismissed.

4. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
