THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37886 of 2015 ORDER:
The grievance of the petitioners was that the Additional Agent to Government and Project Officer, ITDA, Utnoor, Adilabad District, the 2nd respondent, was not taking steps to number the suit filed by them for declaration of title, recovery of possession and for mesne profits. This suit was filed against the 3rd respondent in the writ petition. According to the petitioners, the suit was received by the 2nd respondent on 11.08.2015, but no steps were taken thereafter. As the matter only relates to the numbering of the suit filed by the petitioners and this Court does not propose to enter into the merits of the case, it is not necessary to put the 3rd respondent on notice.
The Additional Agent to Government and Project Officer, ITDA, Utnoor, furnished written instructions to the office of the learned Government Pleader for Social Welfare under letter dated 28.11.2015, wherein he stated that upon receiving the petitioners' suit on 11.08.2015, it was numbered on 12.08.2015 and was admitted on 09.11.2015 with the No.A4/CPC/472/2015. The date of hearing was given as 05.12.2015 and intimation was stated to have been given to both parties. In the light of the aforestated developments, the grievance of the petitioners as to the inaction on the part of the 2nd respondent in processing their case is shown to be without basis. The 2nd respondent shall endeavour to dispose of the petitioners' suit expeditiously.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
